Read the case Bosse v. Brinker Restaurant Corporation d.b.a.Chili’s Grill and Bar (p. 494-5 in your textbook). Remember when reading it two important facts.
- The “patron” (agent) was just a customer at the restaurant – not an employee.
- The restaurant (principal) did not know about the patron and what he was doing until after he called them during the chase.
In this case the court decided that an agency relationship did NOT exist. Regardless of this result, answer the following questions:
- Could an express agency relationship have existed in this case? What would have had to happen?
- Could an implied agency relationship have existed in this case? What would have had to happen?
- Could an agency by ratification have existed in this case? What would have had to happen?
- Could an apparent agency have existed in this case? What would have had to happen?
